EXPLANATORY MEMORANDUM

This Act alters the provisions of the Constitution of the Federal Republic of Nigeria, 1999 to disqualify a person who was sworn-in as President or Governor to complete the term of the elected President or Governor from being elected to the same office for more than a single term.

CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA, 1999 (FOURTH ALTERATION, NO. 16) ACT, 2017

An Act to alter the provisions of the Constitution of the Federal Republic of Nigeria 1999 to disqualify a person who was sworn-in as President or Governor to complete the term of the elected President or Governor from being elected to the same office for more than a single term; and for related matters.

[Commencement] [01 JUNE, 2019]

ENACTED by the National Assembly of the Federal Republic of Nigeria –

1. Alteration of Constitution.

The Constitution of the Federal Republic of Nigeria, 1999 (in this Act referred to as “the Principal Act”) is altered as set out in this Act.

    2. Alteration of section 137Section 137 of the Principal Act is altered, by inserting, after subsection (2), a new subsection “(3)”

      “(3)   A person who was sworn-in as President to complete the term for which another person was elected as President shall not be elected to such office for more than a single term”.

      3. Alteration of section 182

      Section 182 of the Principal Act is altered, by inserting, after subsection (2), a new subsection “(3)”

        “(3)   A person who was sworn-in as Governor to complete the term for which another person was elected as Governor shall not be elected to such office for more than a single term

        4. Citation.

        This Act may be cited as the Constitution of the Federal Republic of Nigeria, 1999 (Fourth Alteration, No. 16) Act, 2017.
