CONSTRUCTION WORKERS SAFETY LAW

A Law to provide for the safety of workers in construction and allied industries in Lagos State and for connected purposes.

[To be proclaimed]                    [Commencement.]

1.   Safety of health and environment guaranteed

(1)     The health and working environment of workers in Construction and Allied Industries in the State is guaranteed under the provisions of this Law.

(2)     Every employer in construction and allied industries shall ensure that the working environment is such that cannot reasonably constitute risk or health hazard to the employees.

(3)     The health week referred to in subsection (2) must aim at educating the workers and employers on the need to maintain a safe working environment and healthy conditions for workers.

3.   Compulsory insurance for workers

As from the commencement of this Law every employer in construction and allied Industries shall insure all employees of the industry against injury to health or other forms of physical injury, accident or death which may occur in the course of duty.

4.   Authorised Officer

(1)     The Ministry responsible for health in Lagos State shall direct authorised officers of the Ministry to enter industries in the State in order to ensure compliance with the provisions of this Law.

(2)     An authorised officer shall serve on any defaulting company with a contravention notice demanding compliance with the provisions of this Law within 7 days of serving such notice.

5.   Offences and penalty

(1)     Any person who fails to comply with the provisions of this Law commits an offence and shall on conviction be liable as follows—

(a)   in the case of a company, to a fine of not more than N500,000.00) five hundred thousand naira);

(b)   in the case of an individual to a fine of not more than N100,000.00 (one hundred thousand naira) or 3 months imprisonment or to both such fine and imprisonment.

(2)     Any person who wilfully obstructs any authorised officer in the discharge of his functions under this Law commits an offence and shall be liable on conviction to a fine of not more than N100,000.00 (one hundred thousand naira).

(3)     Offenders under this law shall be summarily tried by a court of competent jurisdiction.

6.   Regulations

The Commissioner may make regulations generally for carrying into effect the pro-visions of this Law.

7.   Interpretation

In this Law unless the context otherwise requires—

“Court of competent jurisdiction” means a magistrate court or any other court validly established with same jurisdiction;

“Commissioner” means the Commissioner charged with responsibility for health in the State;

“Employer” means any employer of labour in a construction company or a production company;

“Ministry” means the Lagos State Ministry of Health;

“State” means Lagos State of Nigeria;

“Worker” means any person employed to work in any construction or production company.

8.   Citation and Commencement

This law may be cited as the Construction Workers Safety Law and shall come into force on the day of 2003.
