NATIONAL INLAND WATERWAYS AUTHORITY ACT (REPEAL) LAW 2008

A LAW TO REPEAL THE NATIONAL INLAND WATERWAYS AUTHORITY ACT 1997

[Commencement]                                                           [2nd June 2008]

THE LAGOS STATE HOUSE OF ASSEMBLY enacts as follows:

1.      Adoption

In Accordance with section 315(1Xb) of the 1999 Constitution of the Federal Republic of Nigeria, the provisions of sections 2, 8, 9, 10, 11, 12, 13, 18, 23, 24, 27, 28 and 29 of the National Inland Waterways Authority Act 1997 are hereby received and adopted to be a Law made by the Lagos State House of Assembly.

2.      Repeal

(1)     In compliance with section 315(a)(c) of the 1999 Constitution of the Federal Republic of Nigeria, the Lagos State House of Assembly, hereby repeal sections 2, 8, 9, 10, I l, 12, 13, 18, 23, 24, 27,28 and 29 of the National Inland Waterways Authority Act as it relates to Lagos State and same shall not have any effect in the State.

(2)     The functions, powers and jurisdiction vested in the National Inland Waterways Authority Act 1997 shall not apply or extend to streams, creeks, lagoons, intra-State waters, inland waters, waterways and waterfronts within Lagos State.

(3)     The provisions of the National Inland Waterways Authority Act 1997 shall not apply to streams, creeks, lagoons, intra-State waters, inland waters, waterways and waterfronts within Lagos State.

(4)     The National Inland Waterways Authority Regulations for Dues, Rates and Charges (Tariff 1998 and any existing regulations made under the National Inland Waterways Authority Act 1997 encroaching on streams, creeks, lagoons, intra-State waters, inland waters, waterways and waterfronts within Lagos State are hereby repealed and shall not have any effect in Lagos State.

3.      Citations and Commencement

This Law may be cited as National Inland Waterways Authority Act (Repeal) Law 2008 and shall come into force on 2nd June 2008.
