CONSTITUTION OF THE FEDERAL REPUBLIC OF NIGERIA 1999, (FIFTH ALTERATION) (NO. 8) ACT, 2023 [ACT NO. 12]

1. Alteration of the Constitution
The Constitution of the Federal Republic of Nigeria, 1999 (in this Act referred to as “the Principal Act”) is altered as set out in this Act.
2. Alteration of section 54
Section 54 of the Principal Act is altered by inserting after subsection (1), a new subsection “(1A)” —
“(1A) For the purpose of the inaugural and first sitting of the Senate or the House of Representatives, the quorum shall be at least two-thirds of all the members–elect of either the Senate or the House of Representatives.”
3. Alteration of section 96
Section 96 of the Principal Act is altered by inserting after subsection (1), a new subsection “(1A)” —
“(1A) For the purpose of the inaugural and first sitting of the House of Assembly of a State, the quorum shall be at least two-thirds of all the members–elect of the House of Assembly of the State.”
