ADMINISTRATION OF ESTATES (SMALL ESTATE PAYMENTS EXEMPTION) LAW

A LAW TO PROVIDE FOR THE GRANT OF CERTIFICATES TO SMALL ESTATES, EXEMPT SUCH FROM PAYMENT OF ESTATE DUTY AND THE GRANT OF FULL LETTERS OF ADMINISTRATION AND FOR CONNECTED PURPOSES

[Commencement] [4th April 2005]

THE LAGOS STATE HOUSE OF ASSEMBLY enacts as follows:

1.       Small Estates

Where a person living in the State dies leaving a personal estate comprising of money with any person or in any Bank or other institution not exceeding in value the sum of ₦100,000.00 (One Hundred Thousand Naira), such estate shall be regarded as a small estate and this Law shall apply.

2.       Exclusion of other Laws and Rules (Cap. 3)

The Administration of Estates Law, Probate rules, any other Law or rules of court under which grant of Letters of Administration is required for payment of money from the estate of deceased persons shall cease to apply to small estates except as provided for in this Law.
