LAGOS STATE SCHOOLS OF NURSING (GOVERNMENT COUNCIL) LAW
A LAW TO ESTABLISH THE LAGOS STATE SCHOOLS OF NURSING GOVERNING COUNCIL.
[COMMENCEMENT] [26TH JULY 1997]
1. Establishment of the Lagos state Schools of Nursing Governing Council
There is established the Lagos State Schools of Nursing Governing council (referred to as “the Council”)
2. Council to be governing authority of the Complex
Subject to the provisions of this Law, the council will be the governing authority of the Schools of Nursing Complex (referred to as “the Complex”) and is charged with the general control of the Complex under the supervision of the Ministry’
3. Composition of the Council
The Council consists of-
(a) the Chairman who shall be an experienced retired nurse;
(b) three representatives of the Ministry of Health;
(c) one representative of the regulatory body, the Nursing and Midwifery Council of Nigeria;
(d) one representative of the Nurses and Midwives Association;
(e) one representative of the professional association of Public Health Nurses;
(f) one experienced and retired medical officer;
(g) one past principal of the Complex;
(h) the current principal of the Complex; and
(i) two other persons of probity representing public interest.
4. Appointment of members of the Council
The Chairman and other members are to be appointed by the Governor on the recommendation of the State Commissioner.
5. Tenure of Office of Chairman and members
The Chairman and members of the Council will hold office for three (3) years and the Governor may vary such period without giving any reason.
6. Removal of member
The Governor may remove any member of the Council for misconduct or inability to perform the functions of the office.
7. Functions of the Council
It will be the duty of the Council to-
(a) formulate and review the curriculum of the Complex in line with the directives of the Nursing and Midwifery Council of Nigeria and Federal Government guidelines;
(b) select new candidates for the approval of the State Commissioner for admission into the Nursing Schools Complex, that is:
(i) the School of Nursing;
(ii) the School of Midwifery; and
(iii) the School of Public Health;
(c) discipline erring staff and students and recommend appropriate punishment to the State Commissioner;
(d) source for external aids and grants to augment government efforts for the development of the complex and for the welfare of the staff and students of the Complex;
(e) perform such other functions as may be referred to it from time to time by the State Commissioner in relation to the staff and the students of the complex.
8. Secretary to the Council
(1) The Secretary to the Council must be a senior nursing officer not below Grade Level 12 in the State Civil Service appointed by the Council in consultation with the State Commissioner.
(2) The Secretary will be responsible to the Chairman of the Council and under the direction and Control of the Chairman, the Secretary will carry out the day to day administration of the affairs of the Council and in addition the Secretary will be responsible for the following:
(a) making arrangement for the meetings of the Council;
(b) preparing the agenda and the minutes of such meetings;
(c) conveying decisions of the Council to members of the Council;
(d) arranging for the payments of the remuneration and allowances of the members of the Council, and will perform all other duties affecting the Council as may be specifically assigned by the Chairman.
(3) The Secretary will be the link between the Council and the Ministry.
9. Remuneration
The remuneration and allowances of the Chairman and members of the Council are to be determined by the Governor.
10. Meetings and quorum
The Council will meet at least once a month and the quorum for a meeting of the Council must not be less than one-third of the total number of members of the Council.
11. Proceedings
The Chairman will preside at all meetings of the Council, and when absent, such other member of the Council present at the meeting as the members may appoint for that meeting, will preside at the meeting.
12. Interpretation
In this Law unless the context otherwise requires-
“Council” means Lagos State Schools of Nursing Governing Council;
“member” means a member of the Council established under this Law and includes the Chairman;
“Governor” means Governor of Lagos State;
“ministry” means Lagos State Ministry of Health;
“State Commissioner” means the Commissioner or any other person charged with the responsibility for matters concerning Health.
13. Citation and commencement
This Law may be cited as the Lagos State Schools of Nursing (Governing Council) Law, 1997 and will come into force on the 26th day of July 1997.
